By accessing our website at located at www.planetfitness.ca (our "Website") or when you use one of our mobile apps (a "Mobile App") or by otherwise providing personal information to us in connection with our services (our "Services"), you agree to the terms of this Privacy Policy. If you do not agree with these terms, exit this page and do not access or use this site and do not use our mobile apps and do not otherwise provide personal information to us. Our Website and our Mobile Apps are collectively called our "Electronic Properties" in this Privacy Policy.

We want to assure you that Planet Fitness takes privacy matters very seriously and is committed to protecting your privacy. Therefore, we are providing this Privacy Policy to explain our privacy practices and the choices you can make about the way your information is collected and used.

This Privacy Policy applies when you use any of our Electronic Properties or our Services or when you otherwise interact with us. It does not apply to third-party websites, mobile applications or services. Please review the privacy policies on those websites and applications directly to understand their privacy practices.

PRIVACY POLICY UPDATES

We reserve the right to update or modify this Privacy Policy at any time and from time to time without prior notice by posting a revised version of the policy on the Website. If we make material changes to this Privacy Policy, we will notify you using a conspicuous notice on our homepage or direct communication to you via email or your account. Your use of the Electronic Properties or any Planet Fitness facility following any revision to this Privacy Policy constitutes your acceptance that all personal information collected from or about you after the revised policy is posted will be subject to the revised Privacy Policy. PERSONAL INFORMATION

"personal information" in this Privacy Policy means information about an individual. Personal information does not include information that cannot be attributed to an individual, for example, information of an aggregate or anonymous nature.

To the extent that we aggregate or make any personal information anonymous so that an individual cannot be identified, such information is no longer considered to be personal information, and we are entitled to use that information in any manner we desire.

CONSENT

When we collect, use or disclose your personal information we will generally obtain your consent. Most of the time, we will obtain your consent before or at the same time we collect your personal information. When we collect personal information from you, we will inform you of the uses and disclosures that we wish to make of your personal information unless those uses and disclosures are readily apparent at the time we collect the personal information or are set out in this Privacy Policy.

In some instances, however, we may seek your consent after we have collected your personal information if we wish to make an additional use or disclosure of your personal information where we do not already have your consent for that new use or disclosure. This additional consent may be obtained through an amendment to this Privacy Policy as provided above.

You may change or withdraw the consents you have provided at any time on reasonable notice by contacting us as set out below. Further, you may change or withdraw the default consents set out in this Privacy Policy at any time on reasonable notice by contacting us. If you withdraw certain consents, it may limit the manner in which you can make use of our Electronic Properties, use our Services and to otherwise interact with us. For clarity, your ability to change or withdraw consent is not absolute. We reserve the right to continue handling your personal information in those circumstances required or permitted by law despite a change or withdrawal of consent.

Choosing to Provide Personal Information

In using the Electronic Properties and in dealing with us you will have the ability to control the amount of personal information you provide to us and therefore you may restrict the use and disclosure of personal information we collect from you by not providing personal information in connection with the Electronic Properties or to us in the first place. However, if you choose to limit the personal information you provide, it may limit the manner in which you can make use of the Electronic Properties, our Services or otherwise interact with us.

INFORMATION WE COLLECT

We collect information that you provide to us or that is otherwise provided to us on your behalf. You may choose to provide certain information in order to access or use certain features of the Electronic Properties or the Services, such as making a purchase, joining one of our clubs, paying your membership fees, requesting information, providing us with information via text message or our mobile application, filling out an employment or franchise application, entering a sweepstakes, logging into certain exercise equipment consoles using your member keytag, or otherwise contacting us.

We may combine information from the Electronic Properties and Services together and with other information we obtain from our business records. We may use and share information that we aggregate (compile to create statistics that cannot identify a particular individual) or de-identify (strip information of all unique identifiers such that it cannot be linked to a particular individual) at our discretion.

Information you give us

Categories of information we may collect from you include:

  • Identifying information (such as name, age, gender, phone number, e-mail address, mailing address, corporate or educational affiliations, photograph, contact information, and billing information).

  • Commercial information (such as your transaction history with us).

  • Workout and machine usage information.

  • Account information such as username, password, unique user ID, and communication preferences.

  • Credit card or banking information.

  • Payment history.

  • Emergency contact details.

  • Basic physical attributes such as height and weight if you choose to provide them.

  • Details of your visits to one of our Planet Fitness franchisee club locations.

  • Programs and classes you participate in.

  • Reviews and comments.

Information we collect automatically
  • We and partners working on our behalf may use log files, cookies, or other digital tracking technologies to collect information from the device you use to interact with our Electronic Properties. Information we collect automatically includes:

    • Device information, including your computer’s IP address, the address of the web page you were visiting when you accessed our Electronic Properties, the name of the operating system installed on your computer, the name and version of the browser you are using and the date and time of your visit.

    • Analytical information, including details about your interaction with our website, app, and electronic newsletters.

    • Diagnostic information, including web traffic logs.

    • Advertising information, including special advertising and other unique identifiers that enable us or third parties working on our behalf to target advertisements to you. Please be aware that our advertising partners may collect information about you when you visit third-party websites or use third-party apps. They may use that information to better target advertisements to you on our behalf.

  • We create business records when you make purchases or otherwise interact with the Electronic Properties.

  • We use Google Tag Manager to evaluate the use of our Website or our Mobile App. Google Tag Manager uses tags and other identifiers to collect information, such as how often users use our Electronic Properties, what pages they visit, when they do so, and what other websites they visited prior to visiting our Electronic Properties. Google Tag Manager may collect your IP address, data related to the device/browser you are using, and other information about your use of our Electronic Properties. Google Tag Manager provides us with statistical information about the use of our Electronic Properties. We use this information to understand our visitors and to improve our Electronic Properties. We cannot associate any of this information with you or any particular visitor. Google Tag Manager collects information on your activities on our Electronic Properties and may associate it with other information that they may have collected about you and they may use all of this information for their own business purposes. Information we collect from third parties

We may also collect information from other sources such as:

  • Corporate affiliates, which are parent companies, subsidiaries and affiliated entities of Planet Fitness.

  • Social media platforms. If you use a social media platform login to access our Electronic Properties, you will share certain information from your social media account with us including, for example, your name, email address, photo, list of social media contacts, and any other information that may be or that you make accessible to us when you connect your social media account to your services account. The specific information transferred depends on your security settings and the privacy policy of your social media network.

  • Joint marketing partners.

  • Exercise equipment manufacturers.

  • Credit reporting agencies, when you apply for membership using a credit card.

  • Third-party marketing partners, when they share information about your interaction with advertisements that we place on third-party websites or your interaction with our Electronic Properties.

  • Banking verification services & financial institutions. We may use Stripe, Inc. (“Stripe”) or other financial institutions to link and verify the bank account information maintained by your financial institutions. This bank account information may include account and routing numbers and related personal information. By providing us or Stripe with your personal and banking information, you grant us and Stripe the right, power, and authority to act on your behalf to access, transmit, and receive such information from the relevant financial institutions. You agree to your personal and banking information being transferred, stored, and processed by Stripe in accordance with the Stripe Privacy Policy, as may be amended from time to time.

  • From others you specify. If you decide to invite others to the Electronic Properties or Services, we will collect your and the other person’s names, email addresses, and/or phone numbers to send an email or text message and follow up with the other person. You agree that you will obtain the other person’s consent before giving us their contact information. You also agree that you will not send us the contact information of a minor. We will inform any other person you invite that you gave us their information in the invitation email.

HOW WE USE INFORMATION

By providing your information to us, you are authorizing us to collect, use and disclose such information in the manner outlined in this Privacy Policy.

We may use your information for the following purposes:

  • To provide you with access to the Electronic Properties and our Services, such as administering your membership account and sending you administrative information about our terms and policies.

  • To periodically send you newsletters, e-mails, or similar communications featuring sales and promotions, news about new Planet Fitness (or our partners’) products and services, requests for your feedback, or other information we think may be of interest to you.

  • To respond to any customer service inquiries or requests.

  • To promote and administer corporate partnerships in connection with the Services.

  • To provide you with tailored products or service offerings.

  • For internal organizational, analytical, or development purposes, such as conducting data analysis to improve the efficiency of our Electronic Properties or Services, enhancing or improving our current products, services, or offerings, developing new products, services, or offerings, identifying member trends, evaluating the effectiveness of our promotions and campaigns.

  • To combat fraud, and for security and safety purposes, such as detecting abusive or malicious behavior.

  • To comply with legal process, such as warrants, subpoenas, court orders, and lawful regulatory or law enforcement requests, and applicable legal requirements.

  • For any other business purpose for which you provide consent.

HOW WE SHARE INFORMATION

Planet Fitness will only disclose, share or otherwise transfer information for purposes set out in this Privacy Policy, or as required or permitted by law.

Below are categories of recipients with whom we may share your information:

  • Service Providers. Planet Fitness may share your information with service providers or agents who provide services to or on behalf of Planet Fitness or its members such as, but not limited to, point of sale providers, hosting, data management, analytics and storage services, sweepstakes providers, banking verification providers, membership benefits providers and retention services.

  • Corporate Affiliates. We may share information with parent companies, subsidiaries and affiliated entities of Planet Fitness.

  • Law Enforcement Authorities. We may disclose your information to law enforcement authorities when we are required or authorized by law to do so (for example, in response to a subpoena issued by a court).

  • Advertising. We partner with companies that assist us in advertising our Services, including partners that use cookies and online tracking technologies to collect information to personalize, retarget, and measure the effectiveness of advertising.

  • Corporate Partners. We may provide special offers for the Services in connection with certain partnerships with third parties. We may share your information with third parties in connection with promoting and administering these offers.

  • Social Media Platforms. If you interact with us on social media platforms, the platform may be able to collect information about you and your interaction with us. If you interact with social media objects on our Electronic Properties (for example, by clicking on a Facebook “like” button), both the platform and your connections on the platform may be able to view that activity. To control this sharing of information, please review the privacy policy of the relevant social media platform.

  • Other businesses in the context of a commercial transaction: We may change our ownership or corporate organization while providing the Services. We may transfer to another entity or its affiliates or service providers some or all information about you in connection with, or during negotiations of, any merger, acquisition, sale of assets or any line of business, change in ownership control, or financing transaction.

Franchises

As mentioned above, Planet Fitness has a network of franchisees across Canada that provide fitness services. In that regard, Pla-Fit Canada Franchise, Inc. as Franchisor provides a number of services to support its Franchisees. As such, a Franchisee may provide your personal information to the Franchisor to enable the Franchisor to assist with the Franchisee's operations and, the Franchisor may use your personal information in order to provide that assistance. As well, if you visit a new location, that Franchisee will access personal information that you previously provided in order to provide Services to you.

YOUR OPTIONS AND RIGHTS REGARDING YOUR INFORMATION

Your Account: To use certain of the Services and Electronic Properties, you may be required to open an account and to provide certain personal information in connection with that account.

Marketing Communications: If you do not wish to receive marketing information from us or wish to opt out of future email promotions from us, please contact us. Please note that all promotional email messages you receive from us will include an option to opt out of future email communications.

Ad Choices: You have options to limit the information that we and our partners collect for online advertising purposes.

If you exercise these options, please be aware that you may still see advertising, but it will not be personalized. Nor will exercising these options prevent other companies from displaying personalized ads to you.

If you delete your cookies, you may also delete your opt-out preferences.

Managing Cookies, Trackers, Scripts: Many web browsers have settings to notify you when you receive a cookie, web beacons and other trackers and to allow you to block these cookies, web beacons and other trackers and may allow you to disable scripts. If you block any of these items you may not be able to access certain parts of the Website or certain functionality or features may not work properly or may not be available. You may be able to block cookies, web beacons and other trackers and scripts by following the instructions on your browser. Your browser may also allow you to delete cookies and other trackers already stored.

Social Media: Many social media services allow you to select how your personal information is collected, used and shared. Please check with your social media services for your options for managing your personal information.

OTHER COLLECTION, USE AND DISCLOSURE

We may monitor your use of our Electronic Properties to ensure the proper use, operation and security of the Electronic Properties and your compliance with any terms of use related to the Electronic Properties or other related agreements.

As well, the law permits or requires the collection, use and disclosure of personal information without the knowledge or consent of the individual in a number of circumstances. We reserve the right to collect, use and disclose your personal information in these circumstances without your knowledge or consent as the law may permit or require.

ACCESS TO YOUR INFORMATION

You have a right to challenge the accuracy and completeness of your information and to have it corrected, as appropriate. To access or amend your information, please log in to your online account or visit your home club.

You may also request access to your information and inquire about how that information has been used and disclosed, subject to certain exceptions prescribed by law. Please email privacy@planetfitness.com to inquire about the use of your information.

DATA RETENTION

For legal and business purposes we may retain your personal information for as long as it is reasonably needed. Upon expiry of the appropriate retention period, bearing in mind our reasonable legal and business requirements, your personal information will either be destroyed in a secure manner or made anonymous. You should be aware that there are legally required minimum retention periods, which we must and do observe.

SECURITY

Security for all information is extremely important to us. We process your information using a combination of physical, technical, and administrative safeguards designed to protect the information we collect from loss, misuse, unauthorized access or disclosure, alteration, or destruction. Unfortunately, no data transmission over the Internet can ever be guaranteed to be 100% secure. As a result, while we strive to protect your information, Planet Fitness cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.

USE OF THE SITE OR SERVICES BY MINORS

This is a commercial website intended for use by individuals that are at least 18 years old. If you are less than 18 years old, you may not use the Electronic Properties or the Services without prior permission and supervision of your legal guardians. Planet Fitness does not accept members under the age of 13 and does not knowingly collect information from anyone under the age of 13.

STORAGE AND PROCESSING INFORMATION OUTSIDE CANADA

We are headquartered in the United States. As well, certain of our service providers are located outside of Canada. As such, we may transmit your personal information to our affiliated companies and to third parties who are located outside Canada to assist us in the operation of our business. By providing personal information to us, you are consenting to the delivery and the storage, processing and handling of your personal information outside of Canada. Please note that many governments around the world can require that organizations under their jurisdiction deliver information, including personal information, that is in the control of that organization to the government. This is often done without notice to or the consent of the affected individual.

INFORMATION FOR APPLICANTS FOR A FRANCHISEE

When you apply to become a franchisee, we may collect information from you, including:

  • Information you provide in connection with your application.

  • Information that you authorize us to collect via third parties, including credit references, former employers or references.

We will use this information to assess your suitability to be a Planet Fitness franchisee and, if you become a Planet Fitness franchisee, we will use this information in connection with your operation of your franchise.

INFORMATION FOR JOB APPLICANTS

When you apply for a job with us, we may collect information from you, including:

  • Information you provide in connection with your application.

  • As you may authorize or as may be authorized by law, we may collect information via third parties, including former employers or references.

In certain circumstances, you may submit your application for employment through a third-party service that displays our job posting. We do not control the privacy practices of these third-party services. Please review their privacy policies carefully prior to submitting your application materials.

Request Response Procedure and Identity Verification

Only you, or someone legally authorized to act on your behalf, may make a verifiable request related to your personal information. You may also make a verifiable request on behalf of your minor child.

The verifiable request must:

  • Provide sufficient information that allows us to reasonably verify that you are either the person about whom we collected personal information or an authorized representative. We may need to follow up with you to request more information to verify your identity.

  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable request does not require you to create an account with us.

We will only use personal information provided in a verifiable request to verify the requestor’s identity or authority to make the request.

We may have a reason under the law why we do not have to comply with your request, or why we may comply with it in a more limited way than you anticipated.
